Welcome to NUTEJE America's website and services. NUTEJE America is a registered 501(c)(3) nonprofit organization headquartered at 650 W. Bough Ln. Ste 150 PO Box #125, Houston, Texas 77024, United States. Our federal tax identification number is available upon request for donation verification purposes. By accessing our website, making donations, participating in our programs, or using any of our services, you agree to be bound by these terms of service, our privacy policy, and all applicable laws and regulations. These terms apply to all visitors, users, donors, volunteers, program participants, and others who access or use our services.
ORGANIZATION MISSION AND CHARITABLE PURPOSE
NUTEJE America operates exclusively for charitable purposes within the meaning of Section 501(c)(3) of the Internal Revenue Code. Our primary mission is to combat childhood malnutrition in Latin America through the provision of nutritional support, educational programs, and community development initiatives. We currently operate programs in Nicaragua, Venezuela, and Panama, working with local partners including religious organizations, schools, and community groups. Our work includes establishing and maintaining dining halls that serve nutritious meals to children in impoverished areas, supporting educational initiatives that promote child development, and providing emergency food assistance to vulnerable populations affected by economic and social crises.
TAX-DEDUCTIBLE DONATIONS AND FINANCIAL COMPLIANCE
All donations made to NUTEJE America are tax-deductible to the fullest extent allowed by law under Section 170 of the Internal Revenue Code. We will provide official donation receipts for all contributions of $250 or more as required by IRS regulations. For contributions under $250, your canceled check, credit card statement, or bank record serves as your receipt for tax purposes. Donors should consult with their tax advisors regarding the deductibility of their contributions. We maintain complete and accurate financial records in accordance with Generally Accepted Accounting Principles (GAAP) and file annual Form 990 returns with the Internal Revenue Service. Our financial statements are available for public inspection upon request. We are registered with the Texas Secretary of State and comply with all state charitable solicitation requirements.
DONATION TERMS AND CONDITIONS
When you make a donation to NUTEJE America, you agree that your contribution will be used for our charitable purposes as described in our mission statement and program descriptions. While we make every effort to honor donor restrictions and designations, all contributions are ultimately subject to the control and discretion of our Board of Directors to ensure compliance with applicable laws and our tax-exempt purposes. Donations are non-refundable except in cases of unauthorized transactions or processing errors. We use secure third-party payment processors to handle online donations, and we do not store credit card information on our servers. We comply with the Foreign Corrupt Practices Act (FCPA) and maintain strict anti-corruption policies for all international operations. We adhere to Office of Foreign Assets Control (OFAC) regulations and do not provide support to individuals or organizations on sanctions lists. Our international activities are conducted in accordance with all applicable United States laws governing nonprofit organizations operating abroad.
VOLUNTEER AND PARTICIPANT TERMS
Individuals who volunteer with NUTEJE America or participate in our programs agree to additional terms and conditions specific to their involvement. Volunteers may be required to undergo background checks, provide references, and complete training requirements. Volunteers serve at-will and may be dismissed at any time for any reason. Program participants must comply with all program rules and safety requirements. We reserve the right to terminate participation for violations of program rules or for behavior that endangers the safety or wellbeing of other participants or staff. Photographs or videos taken during NUTEJE America programs or events may be used for promotional purposes unless participants specifically opt out in writing.
COMMUNICATIONS AND ELECTRONIC SIGNATURES
By providing your email address or phone number to NUTEJE America, you consent to receive communications from us electronically or by phone. We will communicate with you by email, phone, or by posting notices on our website. You agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing. DISPUTE RESOLUTION AND GOVERNING LAW
These terms shall be governed by and construed in accordance with the laws of the State of Texas and the United States of America, without regard to conflict of law principles. Any dispute arising from or relating to these terms or your use of our services shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Houston, Texas, before a single arbitrator. The arbitrator's decision shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration against NUTEJE America.
MODIFICATIONS TO TERMS AND SEVERABILITY
NUTEJE America reserves the right to modify these terms at any time without prior notice. Your continued use of our services following any changes constitutes acceptance of the new terms. If any provision of these terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The failure of NUTEJE America to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

DONOR BILL OF RIGHTS
NUTEJE America adheres to the Donor Bill of Rights developed by the Association of Fundraising Professionals. Donors have the right to be informed of the organization's mission and the way resources will be used. Donors have the right to be informed of the identity of those serving on our governing board and to expect the board to exercise prudent judgment in its stewardship responsibilities. Donors have the right to have access to our most recent financial statements and to be assured their gifts will be used for the purposes for which they were given. Donors have the right to receive appropriate acknowledgment and recognition and to be assured that information about their donation is handled with respect and confidentiality to the extent provided by law.
